TERMS & CONDITIONS

By having appointments made for you on this service, you agree to comply with our terms as follows.

Stow Park provides appointments for the sole purpose of introducing your services. At no point do we discuss in depth detail or make attempt to give advice on your behalf. Acceptance and use of our service is to fully indemnify Stow Park and all its representatives for any and all liability and loss including but not limited to: fines, losses, damages arising from claims from third parties for any reason. Stow Park shall not be liable to the Client, its directors, servants or agents whether in tort or under statute or common law or otherwise howsoever. All aspects of this contract shall be governed by English law. Under no circumstances will Stow Park be held responsible for not achieving your business objectives. You accept that Stow Park performs a marketing service which is not intended to include risk-management or guaranteed outcomes.

You agree to inform Stow Park immediately of any and all actions concerning legal, statutory and operational function.

We must be notified with a months notice in writing of any holiday dates or amendments to your diary that can effect the arrangement of appointments.

Appointments become valid and payable in full in the event that we are notified of a change subsequent to an appointment/s made.

Data can be provided to us or we can agree to supply data at an agreed cost to you for our purpose of calling. Stow Park enhances the data for the sole purpose of identifying the shareholding directors of the companies targeted. All data remains the property of Stow Park. If the data is in our opinion insufficient or inappropriate for the purpose of making calls, we will mutually agree additional fees for the cost of this data. Data must be reviewed and approved at least 2 weeks in advance to give us the opportunity of enhancing the data for calling purposes. Stow Park will regularly review the data/database available for calling purposes and advise you for the need for more data or for alternate postcodes to reduce the potential for area burnout. Stow Park makes no guarantee and is not liable for the accuracy of data supplied for the purposes of calling which is in the public domain and can randomly vary and change without notice.

Fees and Payment Terms:

The current fee per appointment seen is £260. We promise to give you at least a month’s notice should this change.

At the end of the week where appointments have been seen, an invoice will be sent for all appointments seen in that week. Because we put in a lot of time and effort in advance to create the appointments for you, our payment terms are strictly three days from the date of invoice we send via e-mail. We prefer direct payments into our account and not cheques.

Stow Park will attempt to book more than the number of target appointments required to compensate for any cancellations that might occur unless instructed not to do so by giving advance notice of two weeks prior to calls being made.

What we need to have & do:

We need a minimum of 2 dedicated days for the week for where appointments are to be made. During the course of working on your assignment we will e-mail you details of any appointments made on that day. Unless otherwise explained, in all circumstances an e-mail and/or letter must be sent out by your office to confirm the appointment and our conversation with the prospect.

Appointments we set are ideally 2 hours apart on these dedicated days but should adjacent appointments be close to one another, we reserve the right to make these 1.5 hours. There might be occasions when appointments fall out of these dedicated days in which case we will ask for approval for you to take the appointment.

If an appointment is made, and you subsequently notify Stow Park and or the prospective client for whatever reason that you cannot accept the day and/or time, the appointment will remain valid & chargeable regardless of reason. Once an appointment has been made and presented to you, you are required to make the confirmation on official e-mail or letter documentation. To give you control on matters, we feel it best that any initial rescheduling falls to you but that subsequent reschedules or cancellations fall back to us and become our responsibility. In the event that you are informed that the appointment cancels Stow Park will either replace or rebook the appointment. This may or may not be for the week where appointments are required. If the prospective client reschedules with you and then subsequently cancels and does not want to meet up, you must inform Stow Park immediately. For obvious reasons, you are not allowed to subsequently reschedule cancelled appointments or make attempt to contact or market to appointments that have cancelled either directly or via a third party.

Should a cancelled appointment, at a later date, call in either to your office or ours and reschedule, then this becomes a valid chargeable appointment once again and the same rules apply as above.

All appointments made will be verified to you. In the case of cancellations notified by you, we like to have the option to verify and establish the reason for the cancellation. In the event that the reason for cancellation is a direct result of actions taken or not taken by you then the appointment becomes chargeable in full.

All evidence of confirmation & communication to the prospective client of the appointment must be supplied to Stow Park separately by e-mail. Failure to provide this makes the appointment remain valid and chargeable. Stow Park reserves the right to take any and all action to check on this compliance.

General Definition of a cancellation.

 Prospect not present on the day and time of the scheduled appointment with or without reason given. This would include unforeseen events, forgetting the appointment and time wasters. You must have attended the offices on the allocated day and time as per the appointment sheet provided.

 A confirmed communication clearly stating no wish or desire to have the appointment.

General Definition of what is not a cancellation.

 A request from the prospective client to reschedule is NOT a cancellation.

 A refusal to see you due to lack of punctuality and/or professionalism. This would include being late on arrival and/or a lack of courtesy notice informing the prospect to that effect.

 An appointment that cancels due to actions or failures to act on your part is NOT a cancellation. This would include for example failure to send the confirmation e-mail out, lack of punctuality or professionalism, changing the day and/or time of appointment,
